The franchising agreements of Doctor's Associates LLC's (the franchisor of Subwaysm Restaurants) and Sharkey's Franchising Company (the franchisor of Sharkey's Cut's for Kidssm)  require all disputes related to their franchise agreements to be resolved by arbitration in Connecticut.  These franchise agreements also mandate that disputes about enforceability of arbitrations awards must be brought in state or federal court in Connecticut.

The terms of the franchise agreements used by Doctor's Associates, LLC  (f/k/a DAI)  and Sharkey's Franchising Company almost always include "mandatory arbitration" provisions.  As a result  virtually all disputes between franchisees and these franchisors are initially heard in Arbitration.  Arbitration is often quicker and less expensive than trials to a court: That is the good news.  However, these arbitrations are resolved without published decisions and almost always with non-disclosure requirements.  As a result, franchisees and lawyers who have not handled arbitrations related to these franchises cannot have access to the arbitration decisions:  That is the bad news.
